Clarence Thomas’s conflict of interest on Affordable Care Act

Supreme Court Justice Clarence Thomas has somewhat of a conflict just being a justice, concerning the very right-wing and very prominent political activities of his wife, Ginni. But that conflict is particularly a problem since the Supreme Court will almost undoubtedly be hearing a case against the Affordable Care Act, the law that his wife has been paid handsomely to fight. A Friday afternoon news dump consisting of his financial disclosure form highlights this little problem he has.

His new financial disclosure form indicates that his wife, Virginia, who served as Liberty Central’s president and CEO, received $150,000 in salary from the group and less than $15,000 in payments from an anti-health care lobbying firm she started.The disclosure was apparently prompted in part by Rep. Anthony Weiner (D-N.Y.), who had been needling Thomas (including on Twitter) for months to disclose how much money his wife earned from Liberty Central. That’s because challenges to Obama’s health care reform law are likely to end up before the Supreme Court sooner rather than later, and if Thomas and his wife benefited from her income working against the bill, the justice has an enormous conflict of interest in hearing any legal challenge. Thomas had failed to disclose Virginia’s income on his financial disclosure forms for 20 years; under pressure from Weiner and others, he had recently amended old disclosures to reflect hundreds of thousands of dollars she had earned working for the Heritage Foundation, the conservative think tank that also opposed Obama’s health care plan.

(Gee, I wonder why Rep. Anthony Weiner would be the target of right-wing hackers in a smear campaign over the weekend?)

Then-Atty. Gen. John Ashcroft violated the rights of U.S. citizens in the fevered wake of the Sept. 11 terrorist attacks by ordering arrests on material witness warrants when the government lacked probable cause, a federal appeals court said in a scathing opinion Friday.

In a ruling that said Ashcroft could be sued for prosecutorial abuses, a three-judge panel of the U.S. 9th Circuit Court of Appeals denied the former attorney general immunity from liability for how he used the material witness warrants in national security investigations.

Members of the panel, all appointees of Republican presidents, characterized Ashcroft’s detention policy as “repugnant to the Constitution, and a painful reminder of some of the most ignominious chapters of our national history.”

A Muslim man who was detained for weeks as a material witness in a terrorism case can sue former attorney general John D. Ashcroft, a federal appeals court in California ruled Friday as it rejected a bid for absolute legal immunity by the onetime Cabinet official.

A three-judge panel of the U.S. Court of Appeals for the 9th Circuit gave a green light to the case filed by Abdullah al-Kidd, a U.S. citizen who was taken into custody at a ticket counter at Washington Dulles International Airport in 2003, while he was on his way to Saudi Arabia to study Islamic law and Arabic.

This week marks the end of the dollar’s reign as the world’s reserve currency. It marks the start of a terrible period of economic and political decline in the United States. And it signals the last gasp of the American imperium. That’s over. It is not coming back. And what is to come will be very, very painful.

Barack Obama, and the criminal class on Wall Street, aided by a corporate media that continues to peddle fatuous gossip and trash talk as news while we endure the greatest economic crisis in our history, may have fooled us, but the rest of the world knows we are bankrupt. And these nations are damned if they are going to continue to prop up an inflated dollar and sustain the massive federal budget deficits, swollen to over $2 trillion, which fund America’s imperial expansion in Eurasia and our system of casino capitalism. They have us by the throat. They are about to squeeze.

Obama’s Economic Misfits Finally Get It

Now they tell us.

On Monday, two men with considerable responsibility for enabling the banking meltdown confronted the error of their ways. Not directly, of course, for accountability is hardly the mark of either Lawrence Summers, the top White House economic adviser, or Treasury Secretary Timothy Geithner.

Their careers have long been fueled by error. Summers was one of the leading prophets of radical financial deregulation in the Clinton administration. And Geithner, as head of the New York Fed, looked the other way during Wall Street’s collapse and then responded by opening wide the spigot of taxpayer dollars to resuscitate Citigroup and AIG.

What they wrote this week in a joint Op-Ed article in The Washington Post is a condemnation of the Wall Street shenanigans they once abetted and celebrated. I hope their apparent sudden conversion to common sense indicates the seriousness of the banking regulation plan that President Obama will present to Congress today.
