Terrified and Trying to Dodge the IRS, ALEC Hides Under Shadow Group

ALEC begins their 3 day nationwide meeting today, Wednesday the 4th. All of the big deals in the GOP will be there — including former VP candidate Rep. Paul Ryan (R-WI) and Senator Ted Shutdown Cruz (R-TX).

The American Legislative Exchange Council (ALEC), which claims it does not lobby even though it creates model legislation that its Republican legislative members like John Boehner and Paul Ryan then implement, is concerned about being investigated by the IRS for their charitable tax status claims, according to internal documents from ALEC published by The Guardian.

The documents seen by the Guardian show that Alec is hoping to avoid legal, tax and ethical challenges by creating a separate sister organisation it calls the “Jeffersonian Project”. The new body would be categorised as a 501(c)(4) social welfare organisation, a designation that would allow Alec to be far more overt in its lobbying activities than its current charitable status as a 501(c)(3).

After losing corporate donors who expressed a need to contribute to a tax exempt organization and concern over ALEC’s status, ALEC (with its 501(c)(3) charitable status) has set up a new 501(c)(4) entity, the “Jeffersonian Project”. It will be able to lobby to its hearts content.

In the document, they list benefits of setting up the Jeffersonian Project as removing questions of ethical violations and providing further legal protection. They also clearly lay out how they will use the Jeffersonian Project to further their policy goals: “All ALEC Policy briefs can be sent out as Issue Alerts by the Jeffersonian Project, which can include legislative bill numbers and Support or Oppose positions.”

They continue proving that they are a lobbying group with this, “ALEC can again freely provide testimony on pending legislation.” “Lessens restrictions on our Public Affairs Department by allowing increased communications to the public.”

Included in the documents is a letter from their legal counsel advising that the main activities of the Jeffersonian Project must be devoted to the promotion of social welfare. They lay out that ALEC does not wish to be “perceived” as a lobbying group, and they do not wish to register as a lobbying group in any state. So for states with tougher standards, they will use the Project.

Jan Brewer Recall Possible As Arizona Collective Bargaining Has Democrats, Unions Planning Protests

Arizona could become the next Wisconsin as plans for protests, Capitol sit-ins and a potential effort to recall the governor get underway in an effort by progressives to block the passage of sweeping legislation to ban collective bargaining.

State Democrats and union leaders said that plans are in place to launch Wisconsin-style measures in an effort to block the collective bargaining ban measures currently headed to a vote in the Republican-dominated Senate. Among the plans being considered are rallying large groups of public employees around the Capitol complex in Phoenix, lobbying moderate Republican legislators and potentially exploring a recall campaign against Gov. Jan Brewer (R). With Republicans’ large majorities in both legislative chambers, Democrats believe rallies and public pressure may be the only way to block the passage of the bills.

“You may wake the sleeping giant of Arizona, between attacks on the schools, unions and the Latino population,” state House Minority Leader Chad Campbell (D-Phoenix) said.

Republican lawmakers have proposed bills that would prohibit all public employees — including police and fire personnel — from collectively bargaining, ban the automatic deduction of union dues for public employees and prohibit the compensation of public employees for work done with the union. The bills were approved by the Senate’s government relations committee Wednesday.

“These bills are an all-out assault on workers and the middle class,” said Senate Minority Leader David Schapira (D-Tempe).

Arizona AFL-CIO Executive Director Rebekah Friend said the unions are currently planning the rallies, but did not give a timeframe for when the events would actually take place. She said the labor movement was prepared for the payroll deduction bill and Brewer’s previous announcements on collective bargaining, but were surprised by the scope of the current bills, including the addition of public safety workers.

“They over-reached this time,” Friend said of the state’s Republican leadership. “The people who have been their friends are against them.”

Nearly forty years after a constitutional amendment conferring voting rights on eighteen year-olds was passed into law, and signed by President Richard Nixon, the American Legislative Exchange Council is doing all it can to make it difficult for young people to vote.

Nearly forty years after a Constitutional Amendment giving 18-21 year-olds the right to vote, Republican legislators across the country are trying to disenfranchise youth under the subterfuge of combatting “voter fraud.” However, as Christina Francisco-McGuire recently pointed out at progressivestates.org, instances of *voter fraud “are so rare that one is more likely to be struck by lightening.” Amongst the legislation being pushed in various states are photo id requirements, the abandonment of election-day registration, and the redefining of student residency requirements.

“The American Legislative Exchange Council (ALEC), a conservative organization linked to corporate and right-wing donors, including the billionaire Koch Brothers, [see “Smart ALEC: Dragging the Secretive Conservative Organization Out of the Shadows” — http://blog.buzzflash.com/node/12551] has drafted and distributed model legislation, obtained by Campus Progress, that appears to be the inspiration for bills proposed by state legislators this year and promoted by Tea Party activists, bills that would limit access of young people to vote,” Tobin Van Ostern reported in Campus Progress in early March (“Conservative Corporate Advocacy Group ALEC Behind Voter Disenfranchisement Efforts” —http://campusprogress.org/articles/conservative_corporate_advocacy_group_alec_behind_voter_disenfranchise).

Van Ostern wrote: “According to research by the Fair Elections Legal Network (FELN) and Campus Progress, in the past six years, seven states have enacted laws that disenfranchise students or make it more difficult for them to vote. This year, 18 additional states are considering similar laws, while other states are proposing voter ID laws that would depress turnout among other groups of voters — particularly those who traditionally lean left.

“These requirements run the gamut from requiring in-state driver’s licenses, to banning school IDs, to prohibiting first-time voters – essentially every college-aged voter – from voting by absentee ballot. All together, these barriers create new logistical and financial barriers for many people attempting to vote.”

Van Ostern’s investigation found that “Many of the state proposals appear to stem from model legislation known as the Voter ID Act (also known as Photo ID) that was developed by the American Legislative Exchange Council.

The Koch brothers, owners of Koch Industries are major funders of organizations that create propaganda which denies the reality of climate change. David Koch expressed doubts to the New Yorker magazine last year that climate change is caused by human activity. He also extolled the benefits of climate change, if it happens, stating that it would result in longer growing seasons in colder climates. “The Earth will be able to support enormously more people because far greater land area will be available to produce food,” he said.

The Koch Industries website contains an article that begins by claiming that the company practices environmental stewardship. A couple of paragraphs down, the article states that the company also believes “over-zealous environmental regulation can be destructive.” The article goes on to criticize measures that would reduce greenhouse gas (GHG) emissions.

Greenpeace released a report last year about the Koch foundations supporting organizations that oppose “progressive clean energy and climate policy.” Koch gave $24.9 million from 2005 to 2008 to “organizations of the climate denial machine,” the report states.

The American Legislative Exchange Council (ALEC), a conservative think tank, is one of the organizations that has benefited from Koch money. According to Greenpeace, ALEC’s total grants from 1997 to 2008 from the Koch foundations were $408,000.

The ALEC published a whitepaper titled, EPA’s Regulatory Train Wreck: Strategies for State Legislators. The whitepaper states that the “highest priority should be to get the state on record as calling on Congress to stop this regulatory train wreck.” It cites the “Resolution Opposing EPA’s Regulatory Train Wreck” as a model resolution. Wyoming and Indiana adopted the resolution this year.
